NexGen Networks Acceptable Use Policy

Scope of the Policy
This AUP applies to all users of the Services, including but not limited to subscribers, customers, and any visitors who access the Services.
Legal Compliance: Users must adhere to all applicable laws and regulations in their use of our services.
• Use the Services for lawful, authorized purposes only.
• Respect the intellectual property rights of others.
• Protect their login credentials and not share them with unauthorized users.
Prohibited Activities:
The following activities are prohibited on our network:
- Illegal or fraudulent actions.
- Distribution of viruses, malware, or other harmful software.
- Attempting unauthorized access to systems, data, or networks.
- Distributing content that is defamatory, obscene, harassing, or otherwise objectionable.
- Spamming or sending unsolicited bulk messages.
- Conduct that infringes on the intellectual property rights of others.
Security and Privacy
Protecting Your Information: We take the security of your data seriously. However, it's essential that you also take steps to protect your account and personal information.
Confidentiality: Any sensitive information accessed through our network must be treated with confidentiality and in accordance with data protection laws.
Reporting Security Concerns: Please report any security incidents or vulnerabilities related to our services immediately.
Network Performance and Fair Use
Fair Use of Resources: To ensure all users have a quality experience, we ask that you use our network resources responsibly and avoid excessive consumption of bandwidth.
Monitoring and Enforcement:
We reserve the right to monitor network usage to ensure compliance with this notice. Violations may result in suspension or termination of service and legal action if necessary.
Rights of NexGen Networks.
- NexGen may suspend or terminate Service of any User which NexGen believes has violated any element of this AUP. NexGen will suspend Service for violation of the AUP on the most limited basis as NexGen determines reasonably practical under the circumstances to address the underlying violation. NexGen will attempt to notify Users via email or other method prior to suspending Service for violation of the AUP; provided, however, NexGen may suspend Service without notice if NexGen becomes aware of a violation of any applicable law or regulation or activity, including but not limited to a violation of the AUP that exposes NexGen to criminal or civil liability or that exposes the NexGen network or NexGen customers' network to harm. Such harm to a network may include, but is not limited to, risk of having an IP address placed on blacklists. NexGen may take such further action as NexGen determines to be appropriate under the circumstances to eliminate or preclude repeat violations.
- NexGen reserves the right to take down any material―or otherwise block access to―created or accessible on or through the Services and suspend or terminate
- NexGen reserves the right to cooperate with legal authorities and third parties in the investigation of any alleged wrongdoing related to this AUP, including the disclosure of the identity of the User that NexGen deems responsible for the wrongdoing. NexGen will not be liable for any damages of any nature suffered by any User, or any third party resulting in whole or in part from NexGen’s exercise of its rights under this AUP.
- NexGen reserves the right to install and use, or to have you install and use, any appropriate devices to prevent violations of this Policy, including devices designed to filter or terminate access to the Service. By accepting and using the Service, Users consent to allowing NexGen to collect service information and routing information in the normal course of our business, and to use such information for general business purposes. Users may not use the Service to monitor any data, information or communications on any network or system without authorization. Users may not attempt to gain unauthorized access to user accounts or passwords of other Users.
- In most cases, NexGen will notify Users of complaints received by NexGen regarding an alleged violation of this Policy. You agree to promptly investigate all complaints and take all necessary actions to remedy any violations of this

- NexGen may inform the complainant that you are investigating the complaint and may provide the complainant with the necessary information to contact you directly to resolve the complaint. You shall identify a representative for the purposes of receiving such communications.
- NexGen reserves the right to modify this AUP at its discretion at any time. Such modifications will be effective upon posting, and use of the Services after such modification constitutes acceptance of such modifications.
Responsibility for Content.
NexGen Networks takes no responsibility for any material created or accessible on or through the Services and will not exercise any editorial control over such material. NexGen is not obligated to monitor such material but reserves the right to do so.
Changes to this Notice
NexGen Networks may update this notice periodically. We encourage you to review it regularly to stay informed about how you can help maintain a safe and compliant network environment.
